Family law encompasses any legal issue having to do with the family unit, including divorce with kids, divorce without kids, collaborative divorce, adoption, legal separation, prenuptial agreements, paternity, custody, child support, assets & debt division, gay & lesbian issues, grandparent rights & visitation, military divorce, post decree matters, and mediation. Civil litigation refers to legal disputes between two or more parties who are seeking specific performance or monetary damages, as opposed to criminal sanctions. Law firms who provide civil litigation services do so in hearings, arbitrations mediations, and trials that are held before administrative agencies and local, state and federal courts. Bankruptcy is a process in which consumers and businesses can eliminate or repay some or all of their debts under the protection of the federal bankruptcy court. For the most part, bankruptcies can be divided into two types liquidation and reorganization. Chapter 7 bankruptcy comes under the liquidation category. It's called liquidation because the bankruptcy trustee may take and sell ("liquidate") some of your property to pay back some of your debt. However, you may keep property that is protected (also called "exempt") under state law. There are several types of reorganization bankruptcies, but Chapter 13 is most commonly used by consumers. In Chapter 13 bankruptcy, you keep all of your property, but must make monthly payments over three to five years to repay all or some of your debt. Wills & Trusts also commonly known as Estate planning refers to the legal steps people take to make sure that their wishes regarding their property and health care are honored in the event of their death. These wishes are typically caried out through the establishment of wills and trusts. Probate is the process in which a deceased person's affairs are settled, and this process typically takes place in a court.
